Bavarian Nordic A/S – Complaint against vaccine contract in Germany

On 11 April 2003 the German authority for the review of public procurement awards decided on a complaint regarding the German Government’s award of a vaccine contract to Bavarian Nordic on 7 February 2003. The contract was Bavarian Nordic’s second delivery contract to the Government. The complaint was filed by Baxter Deutschland GmbH claiming that the Government did not observe the rules regarding public tendering procedure.
In its decision the authority found that the German Government did observe the rules regarding public tendering procedure and has rejected the complaint filed by Baxter.
The deadline to appeal the authority’s decision has now expired, and Baxter Deutschland GmbH has decided not to appeal the case against the German Government.
The decision does not affect Bavarian Nordic’s expectations for 2003, which remain a turnover of DKK 500 million and a profit of DKK 250 million before tax.
