Bavarian Nordic Return Goods Policy in Europe
This Return Goods Policy (“RGP”) describes how and whether Bavarian Nordic A/S and its affiliates (“BN”) will reimburse returns of vaccine products you have purchased from BN (“Product”). This Policy may be amended by BN from time to time in its sole discretion, provided that the policy in effect as of the date of the purchase of any Product will govern the return of such Product.
BN will only accept returns in accordance with this RGP and only from customers who are approved by BN and who have purchased the Product from BN directly. Prior to returning Products customers need to obtain a valid Return Goods Authorization (“RGA”) issued by BN Customer Service.
Products awaiting return must be kept in appropriate storage conditions and all historical storage and transport related temperature records must be available upon BN request.
Product Return Goods Authorizations
To obtain authorization to return Product, Customers must contact BN Customer Service by email at sc_customer_service@bavarian-nordic.com with the following information:
- Copy of delivery note or invoice
- Product Name;
- Item number;
- Product Quantity;
- Lot/Batch Number(s);
- Unit Price;
- Billing Address;
- Shipping Address;
- Reason for Return (i.e., concealed damage); and
- Contact Person
Customers will pay all return freight/shipping fees for each shipment of returned Product, except as set forth in this RGP.
Credit issuance is dependent on confirmed receipt and review of returned Product by BN or its designee. Unauthorized returns will be accepted for disposal without any Credit issued.
This RGP applies in addition to BN’s Standard Terms and Conditions or any separate agreement. In case of conflict between, on the one hand, the terms of the RGP, and, on the other hand, the terms of BN’s Standard Terms and Conditions or any separate agreement, the terms of the Standard Terms and Conditions or any separate agreement shall prevail over the terms of this RGP.
Products Eligible for Return and Credit
To be eligible for return, Products must be in the original BN packaging with the original BN label including lot number, expiration date, all barcodes and other tracking elements as required by applicable law.
Products eligible for return under this section may be returned to BN and, provided the conditions hereunder are met, a credit can be issued based upon the actual net purchase price paid at time of purchase (“Credit”). Each Credit for properly returned Products will be issued through the Customer’s account and will expire one-hundred eighty (180) days from the date issued, pursuant to arrangements agreed to by BN. No refunds will be paid out.
No Credit will be provided for lost return shipments or returns received in damaged condition, unless the Product was damaged at receipt.
The following Products may be returned and are eligible for Credit:
- Received by Customer as damaged – Products received with visible damage or obvious shortages in shipment that is reported within the time limits set out in BN’s Standard Terms and Conditions or any separate agreement. Shipments of returned Products must remain in the original carton for inspection.
- Product subject to recall – Any Product subject to recall may be returned for Credit when returned in accordance with BN’s instructions.
- Products with concealed damages / defects reported within the time limits set out in BN’s Standard Terms and Conditions or any separate agreement. Shipments of returned Products must remain in the original carton for inspection.
- Products that have been discontinued by BN and have been returned to BN within three (3) months of the date on which the Product was discontinued.
The amount of the Credit to be issued for properly returned Product will include the cost of shipment to BN of the returned Product (if such shipment costs are paid by the Customer).
Products Eligible for Return Without Credit
The following Products may be returned, but are not eligible for Credit:
- Expired / In-dated Product;
- Product involved in fire, sacrifice or bankruptcy sale or that has been damaged after delivery to the Customer, such as improper storage, heat, cold, water, smoke, fire, or negligence;
- Product that has been opened or partial bottles or dose packs;
- Product that has been received as free goods;
- Product returned by other than the Customer who originally purchased it from BN;
- and Product that has been repackaged or is in another packaging than BN packaging.
All Products eligible for return Without Credit are returned at the Customer’s sole cost and expense, for disposal by BN, and without any Credit issued.
